SMSA COVENANTS, CONDITIONS & RESTRICTIONS (CC&Rs)

The original developer of the Association filed the Covenants in 1976 in the Circuit

Courts of both Rockingham and Shenandoah Counties.  Since that time, the

old Covenants have become outdated, not always reflecting current

federal, state and county laws and ordinances.  In addition, the assessment fees

as indicated in the original Covenants do not reflect the current assessments.

2020 proposed Amendment

At the November 14, 2020 Annual Meeting members overwhelmingly voted to

amend the outdated annual assessment declaration to agree with the bylaws

which states that assessments are…

“An amount that is based upon the budget approved at the annual meeting

divided equally by the number of properties liable for payment of the

assessment.”

 

Now awaiting Ratification of 2/3 of the membership, this is a short modification

to ensure that our dues meet our budgetary requirements yearly. Below,

please find the full text of the amended Covenants and the required ratification

form for your signature.  We ask that you sign the ratification form and return

at your earliest convenience in order to finalize this and get our Covenants

up to date.

2018 proposed Full Revision


In 2018, the Association began work on a full revision of the CC&Rs to reflect

current condtions and to adhere to new federal, state and local laws.  That work

has been ongoing and the final revisions are now ready for membership review

and vote for ratification.  The new CC&Rs will be identical for both counties and

will be filed in both circuit courts when ratified.
